These Terms & Conditions govern the use of the Heritage Creations® website and purchases made from The Heritage Craft Creations UK Ltd. Please read them carefully before placing an order.

By placing an order through our website, you agree to these Terms & Conditions. Nothing in these Terms affects your statutory rights as a consumer.

2. WEBSITE USE

By using this website, you agree to use it lawfully and responsibly.

You must not misuse, interfere with, disrupt, damage or attempt to compromise the security, availability or functionality of the website, or use the website for any unlawful or fraudulent purpose.

We may update, modify, suspend or withdraw parts of the website where reasonably necessary.

3. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, specifications, dimensions, prices and imagery displayed on our website are accurate.

Many Heritage Creations® products are handcrafted using natural materials and traditional techniques. As a result, individual pieces may feature minor variations in grain, carving, texture, tone, patina, finish or detailing. Such variations are inherent characteristics of handcrafted and natural-material products and do not necessarily constitute defects.

Colours may appear differently depending on screen settings, lighting conditions and photography. Unless expressly stated otherwise, dimensions and measurements may be subject to reasonable manufacturing tolerances.

Nothing in these Terms affects your statutory rights. Goods supplied to consumers must be as described, of satisfactory quality and fit for purpose in accordance with applicable consumer law.

4. MADE-TO-ORDER & HANDCRAFTED ITEMS

Many Heritage Creations® products are handcrafted, produced to order or available with bespoke options.

Production and delivery times may vary depending on the nature of the item, artisan production schedules, materials, finishing processes and the level of customisation required.

Where an item is made to your individual specifications or is clearly personalised for you, statutory cancellation rights may not apply where permitted by law.

An item being manufactured or assembled after an order is placed does not, by itself, necessarily mean that it falls within the legal exception for bespoke or personalised goods. Where statutory cancellation rights apply, they will not be excluded merely because an item is described as made-to-order.

This does not affect your statutory rights where an item is faulty, damaged, not as described or otherwise does not conform to the contract. The cancellation exception under distance-selling rules covers goods made to a consumer’s specifications or clearly personalised.

5. PRICING

Prices displayed on our website are shown in GBP (£) unless otherwise stated.

Prices payable by UK consumers include applicable VAT where required. Delivery charges and other applicable mandatory charges will be disclosed before an order is placed or, where they cannot reasonably be calculated in advance, information will be provided explaining how they are calculated.

For international customers, additional import duties, taxes or customs charges may apply as described in Section 9.

We take reasonable care to ensure that prices displayed on our website are accurate. If we discover an obvious pricing error before an order has been accepted, we will notify you and may provide you with the option to proceed at the correct price or cancel the order.

We may change prices for future orders at any time. Any such change will not affect an order that has already been accepted by us, except where required by law or agreed with you.

UK online-selling rules require businesses to provide the total price, or explain how it will be calculated, and the total delivery cost or its calculation before purchase.

6. PAYMENT

We accept secure payment methods made available through our website checkout, which may include:

• Major debit and credit cards
• Apple Pay
• Google Pay
• Other payment methods displayed at checkout

Available payment methods may vary depending on your country, currency, device and checkout configuration.

Payments are processed through trusted third-party payment providers. We do not store full payment card details on our own servers.

Orders will only proceed once the required payment has been successfully authorised, unless another payment arrangement has expressly been agreed with us.

7. ORDER ACCEPTANCE

After placing an order, you will receive an electronic acknowledgement confirming that we have received your order. This acknowledgement does not necessarily constitute acceptance of your order.

A contract between you and The Heritage Craft Creations UK Ltd is formed when we expressly accept your order, which may occur when we send an order acceptance or dispatch confirmation, depending on the nature of the product.

Before acceptance, we may decline or cancel an order where, for example:

• Payment cannot be authorised;
• There is an obvious pricing or product information error;
• A product or required material is unavailable;
• We cannot reasonably deliver to the specified destination;
• We reasonably suspect fraud or unlawful activity; or
• We are unable to fulfil the order for another legitimate reason.

If we do not accept an order for which payment has already been taken, the relevant amount will be refunded.

We reserve the right to limit quantities where reasonably necessary.

8. SHIPPING & DELIVERY

We offer domestic and international delivery to destinations supported by our delivery network.

Estimated production and delivery times are provided in good faith. Made-to-order and bespoke products may require longer production periods, and the applicable estimated timeframe will be communicated before or at the time of order.

Unless a different delivery period has been agreed with you, applicable statutory delivery requirements will apply. UK distance-selling guidance states that goods should generally be delivered within 30 days unless another timeframe has been agreed with the customer.

Delivery may occasionally be affected by circumstances such as artisan production schedules, customs clearance, carrier disruption, severe weather or other events outside our reasonable control. Where a significant delay occurs, we will communicate with you and your statutory rights will remain unaffected.

Customers are responsible for providing complete and accurate delivery information.

9. INTERNATIONAL ORDERS, DUTIES & TAXES

We sell and deliver products internationally to selected destinations.

For international orders, import duties, customs charges, local taxes or regulatory fees may apply depending on the destination country, product, value and applicable local laws.

Unless expressly stated at checkout or in your order confirmation that such charges are included, the customer may be responsible for applicable import duties, customs charges, local taxes and regulatory fees imposed by the destination country.

Where duties or taxes are collected by us at checkout, this will be indicated before the order is placed.

Customs procedures may occasionally result in delivery delays outside our reasonable control.

10. CANCELLATIONS, RETURNS & REFUNDS

If you are a consumer purchasing online, you may have a statutory right to cancel your order without giving a reason within 14 days after receiving the goods, subject to exceptions provided by law.

To exercise a cancellation right, please contact us at:

contact@theheritagecreations.co.uk

Where the statutory cancellation right applies, you generally have a further 14 days after notifying us of cancellation to return the goods.

Unless otherwise required by law or agreed by us, you are responsible for the direct cost of returning unwanted goods. For goods which cannot normally be returned by post, information regarding applicable return arrangements and costs will be provided as required.

Where a statutory cancellation applies, refunds will be made in accordance with applicable law, including reimbursement of the standard outbound delivery charge where required.

We may make a deduction from the refund where permitted by law if the value of returned goods has been reduced as a result of handling beyond what would reasonably be necessary to establish their nature, characteristics and functioning.

The statutory cancellation right may not apply to goods made to your individual specifications or clearly personalised for you.

Nothing in this section limits your statutory rights in relation to goods that are faulty, damaged, misdescribed or otherwise do not conform to the contract.

11. DAMAGED OR FAULTY ITEMS

If an item arrives visibly damaged, we ask that you contact us as soon as reasonably possible, must be within 48 hours of delivery, at contact@theheritagecreations.co.uk.

Must provide:

• Your order number;
• Photographs of the item;
• Photographs of the packaging; and
• A description of the issue.

Providing this information promptly helps us investigate damage with our delivery partner.

If goods are faulty, damaged, not as described or otherwise do not conform to the contract, you may be entitled to a repair, replacement, refund or other remedy as provided by applicable consumer law.

12. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of this website, including branding, logos, text, graphics, product photography, original product imagery and other content owned by The Heritage Craft Creations UK Ltd is protected by applicable intellectual property laws.

Heritage Creations® is a registered trademark in the United Kingdom.

You may not reproduce, distribute, commercially exploit or use our protected content without prior written permission, except where such use is permitted by law.

Nothing in this section claims ownership of intellectual property belonging to third parties.

13. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot otherwise lawfully be excluded or restricted.

Nothing in these Terms excludes or restricts your statutory rights relating to goods.

Subject to applicable law, we will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising from circumstances for which we are not legally responsible.

If you are purchasing as a consumer, we are not responsible for business losses, including loss of profits, revenue, business opportunities or commercial interruption arising from your use of products primarily for business purposes, to the extent permitted by law.

14. PRIVACY & COOKIES

We process personal information in accordance with our Privacy Policy and applicable data protection law.

Our website also uses cookies and similar technologies as described in our Cookie Policy.

Please review our Privacy Policy and Cookie Policy for further information about how personal information is collected, used and protected and how cookies and similar technologies are used.

These websites are operated independently and may have their own terms, privacy policies and practices. We are not responsible for the content or practices of third-party websites except to the extent required by applicable law.

We recommend reviewing the applicable terms and privacy information when visiting third-party websites.

16. FORCE MAJEURE

We will not be responsible for a failure or delay in performing our obligations where that failure or delay results from circumstances outside our reasonable control.

Such circumstances may include severe weather, natural disasters, transport or carrier disruption, customs delays, strikes or industrial action, governmental restrictions, supply-chain disruption or other events that could not reasonably have been prevented.

Where such an event materially affects your order, we will take reasonable steps to minimise the impact and communicate relevant information to you.

17. GOVERNING LAW & JURISDICTION

These Terms & Conditions and contracts between you and us are governed by Scots law.

If you are a consumer resident elsewhere, you may also benefit from mandatory protections provided by the laws applicable in your country of residence which cannot lawfully be excluded by these Terms.

Disputes will be subject to the jurisdiction of the Scottish courts, without affecting any right you may have as a consumer under applicable law to bring proceedings in another competent jurisdiction.

18. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time to reflect changes in our business, website, services, policies or applicable law.

The Terms applicable to an order will generally be those in effect when the order is placed, unless a change is required by law or otherwise agreed with you.

The date at the top of this page indicates when these Terms & Conditions were last updated.
